Apple to Fight Ruling

by A.M. Watts

What if Apple really conspired to manipulate Amazon’s e-book pricing?

Apple (AAPL) says it will fight the recent ruling against the company in the case of e-book pricing, says Tom Neumayr, spokesman for Apple.  Mr. Neumayr says these are “false allegations.”

Judge Denise Cote

Judge Denise Cote

It seems the judge in the case, Honorable Denise Cote ruled in favor of the claim stating,  “The plaintiffs have shown that the publisher defendants conspired with each other to eliminate retail price competition to raise e-book prices, and that Apple played a central role in facilitating and executing that conspiracy,” Cote said in today’s opinion.

The ruling leaves Apple in a precarious position to continue the battle to clear its name of conspiracy charges that, if clearly executed,  would have affected how Amazon.com charges for sales of e-books.

Thank you, TiA

Apple’s decision to fight the Court decision is simply a very bad decision for them. I am sure that they feel abused and that their point of view is right, but the brand image implications for Apple are horrible. As we have Job’s own admission in his book, and all of the other defendants have pleaded guilty, Apple’s decision only projects an image of corporate arrogance and defiance, rather like the Microsoft of the 1990’s..
